LASTING POWERS OF ATTORNEY
Lasting Powers of Attorney are legal documents, in which you nominate individuals of your choice to look after your affairs, in case you are unable to do so yourself.
There are two types of LPA;
a) Finance and Property- this document will enable your chosen attorneys to access and manage your: bank and building society accounts, savings and investment accounts, deal with any property that you own and apply for benefits on your behalf.
b) Health and Welfare- this document will enable your chosen attorneys to make decisions regarding health and welfare matters, if you loose capacity to make these decisions for yourself. Our view is that the Health and Welfare LPA is in many ways more important than Finance and Property, since it covers your whole well being and lifestyle and most people would say it is essential that these aspects should be under the control of your family rather than social services or medical professionals.
Attorneys and replacement attorneys
You can appoint several attorneys to act for you and you can also appoint replacement attorneys (replacement attorneys will ONLY act if your original attorneys cannot or no longer wish to act for you).
Court registration
The documents cannot be used until they are registered with the Office of the Public Guardian (this is part of the Court of Protection).
